The seminar will address the question of the mobilisation (or non-mobilisation) of the notions ‘culture’ and ‘cultural diversity’ by the different actors of the judicial system, specifically in family and youth justice. The focus on family and youth justice is indeed relevant as it allows to get access to the intimate and private sphere of families with migration background in institutional spheres that are not directly – or at least not explicitly – related to migration (as opposed to e.g. international private law, immigration or asylum law, etc.). The presentations and discussions will address several topics, such as:

• The definition, the reference and the use (or non-use) of the notions of ‘culture’ or ‘cultural diversity’ as an argumentative and/or descriptive resource by different actors in the field – professional actors and families themselves.
• The different methodological or analytical frameworks that can be adopted to address the question of ‘culture’ or ‘cultural diversity’ in family and youth justice.
• The results and perspectives of our different studies: what are the impacts of these mobilisations on experiences of judicial interventions or on judicial trajectories? What are the effects on the decision making and for family and youth justice? Etc.
• It is necessary for the family justice system to improve its practices, and if so, which scenarios or (possible) best practices are we able to develop?
